"Just lost in court to TB Penick. The jury decided that incompetent management was not discrimination. TB Penick should look into this problem (90 day rule that is taken for granted) so it does the right thing along with being fair to persons with disabilities. (BTW, the jury believed that Management was untruthful in court. This type of employee gives a black eye to a good company, the jury's decision would have still been the same if he had told the truth as they believed my statements that I had worked for T.B. Penick and Sons, Inc. If I hadn't told them I had a disability I wouldn't have been let go for being over the 90 day rule. How the jury could ignore this is beyond comprehension."

"T.B. Penick & Sons is a very large, successful, 3rd generation family owned Concrete Contractor. They have a good balance between their 3 divisions, an excellent reputation, a good credit rating and are considered to be a national leader in their Architectural Concrete division, of which I was a member."

"It is an excellent working environment, very challenging & creative work (architectural concrete), good advancement potential, good benefits and very financially stable."
What don't you like about working at T.B. Penick & Sons?
"Their project managers tend to be overburdened with paperwork and financial analysis. While I was there, they were transitioning between a combined estimator/project manager to splitting the functions and they were also changing their project accounting & management software from Timberline to Cheetah. There were naturally some difficulties associated with these transitions."
What suggestions do you have for management?
"The compensation structure is heavily based upon performance bonuses, which are determined by very complicated mathematical formulas. The emphasis is on division performance, rather than individual effort, yet, in my experience, successful construction management has always been about individual performance, where a collection of individuals' experience, skills, work ethic and conscientiousness determine the eventual success of the group. My suggestion would be to simplify the process and incorporate more emphasis on individual achievement."
